MetaPress Terms and Conditions

1. Introduction and Acceptance of Terms
Welcome to MetaPress. This document outlines the terms and conditions (the “Terms”) governing the use of the MetaPress software and services. By installing, accessing, or using MetaPress, you agree to be bound by these Terms.

2. Subscription and Payment Terms
MetaPress is offered as a subscription-based service with a commitment to fair use. The subscription fee is $5 per month, payable via PayPal. Subscribers can start, stop, and resume their subscriptions at any time, with the understanding that stopping a subscription will result in loss of access to the editor and third-party plugin installation capabilities.

MetaPress operates on a fair use basis. Any use of the software that circumvents revenue generation for MetaPress, or is deemed to be in violation of the principles of fair use, may result in the immediate termination of service at the sole discretion of MetaPress. This includes, but is not limited to, unauthorised distribution, modification, or exploitation of the software in ways that deprive MetaPress of due revenue.

The Beta version of MetaPress is offered free of charge. Paid services will commence upon the conclusion of the Beta period, and access to the editor will require an active subscription.

3. Refund Policy
Refunds are granted at the sole discretion of MetaPress. Users may request a refund, subject to review and approval by MetaPress.

4. License Grant and Restrictions
MetaPress grants you a non-exclusive, non-transferable license to use the software in accordance with these Terms. You may not copy, modify, or reverse-engineer the software, except as expressly allowed under a paid subscription for external plugin use.

5. User Conduct and Responsibilities
Users are responsible for all content created or uploaded using MetaPress. Illegal, offensive, or harmful use of the software is strictly prohibited. Users agree to comply with all applicable laws and regulations in their use of MetaPress.

6. Third-Party Plugin Installation and Use
MetaPress allows the installation and use of third-party plugins. Users acknowledge that MetaPress is not responsible for any third-party content and agrees to use such plugins at their own risk.

7. Liability and Indemnification
MetaPress provides the software “as is” without any warranties. MetaPress will not be liable for any damages arising from the use of the software. Users agree to indemnify and hold harmless MetaPress from any claims, damages, or expenses arising from their use of the software.

8. Termination and Access Restriction
MetaPress reserves the right to terminate or restrict access to the software for any user who violates these Terms.

9. Changes to Terms and Software
MetaPress reserves the right to modify these Terms and the software at any time. Users will be notified of significant changes through appropriate channels.

10. Governing Law and Jurisdiction
These Terms are governed by the laws of South Africa. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of South Africa.

11. Miscellaneous
If any part of these Terms is found to be unenforceable, the remainder of the Terms will remain in effect.

12. Data Protection and Privacy
MetaPress is committed to protecting the privacy and security of our users’ data. We comply with all applicable data protection laws, including the Protection of Personal Information Act (POPIA) in South Africa. Our Privacy Policy, which is a separate document, details how we collect, use, store, and protect user data.

13. Intellectual Property Rights
All intellectual property rights in the MetaPress software and services are owned by MetaPress or its licensors. Users retain ownership of the intellectual property rights in the content they create or upload. However, by using MetaPress, users grant us a license to use this content as part of providing and improving our services. We respect intellectual property laws and expect our users to do the same.

14. User Support and Service Availability
MetaPress endeavours to provide continuous, uninterrupted service, but does not guarantee that the service will always be available or uninterrupted. We will provide user support and make reasonable efforts to ensure that scheduled maintenance causes minimal disruption.

15. Termination Policy for Breach of Terms
In the event of a breach of these Terms, MetaPress reserves the right to suspend or terminate the user’s access to the software. Users will be notified of the breach and may be given an opportunity to rectify the situation before termination, depending on the severity of the breach.

16. Dispute Resolution Mechanism
Any disputes arising out of or in connection with these Terms shall be initially addressed through direct negotiation. If a resolution is not reached, the dispute may be subjected to mediation or arbitration, as agreed upon by both parties, before resorting to litigation.

17. Limitations of Use
Users must not use MetaPress for any unlawful, fraudulent, or malicious activities, including but not limited to hacking, spamming, distributing malware, or infringing upon the rights of others.

18. Modification and Third-Party Content
While users may modify their MetaPress environments, such modifications must not violate any laws or third-party rights. MetaPress is not responsible for the content of third-party plugins or modifications.

19. Jurisdiction-Specific Clauses
These Terms are governed by the laws of South Africa. However, if MetaPress is used outside South Africa, international laws may also apply. Users are responsible for compliance with local laws.

20. Accessibility and Inclusivity
MetaPress is committed to providing an inclusive and accessible service. If you have accessibility needs, please contact us, and we will make reasonable efforts to accommodate you.

21. Feedback and User Contributions
Any feedback, comments, or suggestions you may provide regarding MetaPress is entirely voluntary, and we will be free to use such feedback without any obligation to you.

22. Emergency Service Disclaimer
MetaPress is not designed for emergency or life-saving purposes. Users should not rely on MetaPress for such situations.
